JOINT RESOLUTION

Designating  November 2, 2004, as `Federal Election Day' and making such day a legal public holiday, and for other purposes.

Resolved by the Senate and House of Representatives of the United States of America in Congress assembled,

SECTION 1. SHORT TITLE.

This Act may be cited as the `Federal Election Day Act of 2002'.

SEC. 2. ELECTION DAY OBSERVED.

(a) DESIGNATION- November 2, 2004, are designated as `Federal Election Day'.

(b) LEGAL PUBLIC HOLIDAY- Federal Election Day--

(1) is a legal public holiday for the purpose of statutes relating to pay and leave of employees;

(2) shall be treated as a holiday in accordance with section 6103 of title 5, United States Code; and

(3) shall begin at 1 o'clock post meridian.

(c) REGULATIONS- The President may prescribe regulations to carry out this section.

SEC. 3. GAO STUDY.

(a) IN GENERAL- The Comptroller General shall conduct a study of the impact on voter participation of making Federal Election Day a legal public holiday.

(b) REPORT- Not later than May 2, 2005, the Comptroller General shall submit a report to Congress and the President detailing the results of the study conducted under subsection (a).
